REVIME TERMS OF SERVICE

These Terms of Service ("Terms") govern access to and use of Revime, including the website getrevime.com, the application revime.app, related dashboards, public customer pages, APIs, integrations, and any related services operated by Vitalij Borysovyč Ševerov, OSVČ, trading as Revime ("Revime", "we", "us", or "our").

By creating an account, accessing the Services, or using the Services on behalf of a business, you agree to these Terms. If you use the Services on behalf of a company, sole proprietor, flower shop, salon, or other business, you represent that you have authority to bind that business to these Terms.
1. The Services
Revime is a customer-retention SaaS platform for flower shops and similar businesses. The Services help businesses manage customer reminder dates and automatically send personalized reminders through supported communication channels, including SMS, WhatsApp, and Telegram.
The Services may include:
- an internal administrative interface operated by Revime;
- a dashboard for business clients;
- public customer pages protected by unique access tokens;
- automated reminder scheduling and delivery;
- consent, opt-in, opt-out, and communication preference management;
- integrations with third-party communication providers.
Revime does not sell flowers, arrange flower delivery, or act as the merchant of record for purchases made between a client business and its customers.
2. Business Use
The Services are intended for businesses and persons acting in connection with a business or professional activity. You may not use the Services for personal household purposes, unlawful marketing, spam, or communications unrelated to your business relationship with your customers.
3. Accounts
To use the Services, you may be required to create an account. You must provide accurate and complete account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us promptly if you suspect unauthorized access to your account.
4. Free Trial
Revime may offer a 14-day free trial. Unless otherwise agreed in writing, the free trial gives you temporary access to the Services for evaluation purposes.
At the end of the trial, access may be suspended unless you upgrade to a paid subscription or agree another arrangement with Revime.
5. Fees and Payment
At the current stage, payments are handled by bank transfer unless otherwise agreed. Subscription fees, billing periods, and payment terms will be agreed with you separately or displayed in the Services.
All fees are non-refundable unless Revime decides otherwise in a specific case or unless required by applicable law.
Unless otherwise agreed in writing, subscription fees do not include taxes, levies, duties, bank fees, currency-conversion fees, or telecommunications and messaging charges that may be billed separately or passed through to you.
Revime may introduce third-party payment processors in the future. If this happens, the applicable payment provider may process payment data under its own terms and privacy notice.
6. Customer Communications
The Services automatically determine when communications should be sent based on customer data, reminder dates, consent records, opt-out records, preferred channels, and communication rules applied by Revime.
You acknowledge that messages may be sent automatically on your behalf. You are responsible for ensuring that the customer data you provide and the communications sent through the Services comply with applicable privacy, electronic communications, marketing, telecommunications, consumer protection, and anti-spam laws.
Revime may apply frequency limits, consent controls, opt-in checks, opt-out suppression, delivery checks, eligibility rules, and other safeguards. These safeguards are provided to support compliance and service quality, but they do not transfer legal responsibility for your communications from you to Revime.
You must not use the Services to send unsolicited commercial messages, spam, unlawful marketing messages, misleading messages, abusive messages, or messages to persons for whom you do not have a lawful basis to communicate.
Revime may suspend, block, throttle, or refuse message delivery if we reasonably believe that your use of the Services may violate applicable law, third-party provider rules, platform policies, carrier requirements, or these Terms.
You are also responsible for the content of messages sent through the Services, including ensuring that message content is accurate, not misleading, identifies the relevant business where required, and includes or links to any required opt-out or preference-management mechanism.
7. End Customer Pages
Revime may provide public pages for your customers, protected by unique access tokens. These pages may allow customers to view reminder information, update relevant dates, confirm consent, withdraw consent, or choose a preferred communication channel.
You are responsible for ensuring that your customers receive appropriate privacy notices and understand that you are the business responsible for deciding why their data is processed. Revime acts primarily as a service provider and data processor for customer data processed on your behalf, as described in the Data Processing Agreement.
You must not share access-token links with unauthorized persons or use tokenized pages in a way that could compromise customer privacy.
8. Data Protection
The processing of personal data is governed by our Privacy Policy and, where Revime processes personal data on behalf of a client, by our Data Processing Agreement.
By using the Services, you agree to the Data Processing Agreement where applicable. You are responsible for having a lawful basis for processing customer personal data and for providing all notices required by applicable law.
You must maintain accurate business identity and contact information in the Services so that customer-facing notices, preference pages, and communications can identify the relevant business controller where required.
9. Client Data
You retain ownership of the data you submit to the Services. You grant Revime the rights necessary to host, process, transmit, display, and otherwise use Client Data solely to provide, secure, maintain, and improve the Services and to comply with applicable law.
You must not upload or process through the Services any special-category or high-risk data unless expressly agreed in writing. This includes health information, biometric data, political opinions, religious beliefs, sexual orientation data, criminal records, or data relating to children under 16.
10. Prohibited Use
You must not:
- use the Services for unlawful, misleading, fraudulent, abusive, or harmful purposes;
- use the Services to send spam or unlawful marketing communications;
- upload data you have no right to process;
- interfere with or disrupt the Services;
- attempt to bypass security, rate limits, consent controls, or opt-out suppression;
- reverse engineer or copy the Services except where permitted by law;
- use the Services to build a competing product;
- access the Services using unauthorized bots, scrapers, or automated tools;
- introduce malware or harmful code;
- violate third-party messaging, carrier, Meta, WhatsApp, Telegram, Twilio, or similar platform rules.
11. Third-Party Services
The Services rely on third-party infrastructure and communication providers, including hosting, database, security, and messaging providers. Third-party providers may change over time.
Revime is not responsible for failures, delays, delivery issues, outages, suspensions, policy enforcement, pricing changes, or restrictions imposed by third-party providers, carriers, messaging platforms, or networks.
12. Availability and Changes
The Services are provided on an "as is" and "as available" basis. Revime does not provide a service-level agreement unless expressly agreed in writing.
We may modify, suspend, discontinue, or restrict parts of the Services at any time, including to maintain security, comply with law, respond to provider restrictions, or improve the product.
13. Intellectual Property
Revime and its licensors own all rights in the Services, including software, workflows, design, branding, documentation, and related intellectual property.
Subject to these Terms, Revime grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes.
You may not copy, resell, sublicense, reproduce, modify, or create derivative works from the Services except as expressly permitted by Revime in writing.
Feedback you provide about the Services may be used by Revime without restriction or compensation, provided that we do not disclose your confidential information.
14. Confidentiality
Each party may receive non-public information from the other. Each party agrees to use reasonable care to protect confidential information and to use it only for purposes related to the Services.
Confidentiality obligations do not apply to information that is public, already known without restriction, independently developed, or required to be disclosed by law.
15. Suspension and Termination
You may stop using the Services at any time. Revime may suspend or terminate access if:
- you breach these Terms;
- you fail to pay fees when due;
- your use creates legal, security, operational, or reputational risk;
- your use violates messaging-provider rules or applicable law;
- continued provision of the Services becomes impractical or unlawful.
Upon termination, your right to use the Services ends. Data export and deletion are handled according to the Privacy Policy and Data Processing Agreement.
16. Disclaimers
To the maximum extent permitted by law, the Services are provided without warranties of any kind, whether express, implied, statutory, or otherwise. Revime does not warrant that the Services will be uninterrupted, error-free, secure, or that any message will be delivered, read, or acted upon.
Revime does not provide legal advice and does not guarantee that your use of the Services complies with privacy, marketing, telecommunications, or consumer protection laws.
17. Limitation of Liability
To the maximum extent permitted by law, Revime will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity.
To the maximum extent permitted by law, Revime's total aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount paid by you to Revime during the three months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnity
You agree to indemnify and hold harmless Revime from claims, damages, losses, liabilities, penalties, costs, and expenses arising from:
- your Client Data;
- your customer communications;
- your breach of these Terms;
- your violation of applicable law;
- your violation of third-party rights;
- your failure to obtain or maintain a lawful basis for communications or data processing.
19. Updates to These Terms
Revime may update these Terms from time to time. If changes are material, we will provide reasonable notice by email, in-product notice, or publication on our website. Continued use of the Services after the effective date means you accept the updated Terms.
20. Language
These Terms are provided in English. Any translations are provided for convenience only. In case of inconsistency, the English version prevails.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules.
The courts of Prague, Czech Republic, will have jurisdiction over disputes arising out of or relating to these Terms, except where mandatory law provides otherwise.
